TERMS OF SERVICE

These Terms of Service govern your use of hausoutdoorliving.com and any services provided by HAUS Outdoor Living LLC (“HAUS,” “we,” “us,” or “our”). By using our website, requesting an estimate, approving a proposal, enrolling in HAUS Care, or purchasing services, you agree to these Terms.

  1. SERVICES

HAUS provides outdoor-property services that may include artificial-turf cleaning, deodorizing, sanitization, extraction, turf repairs, paver cleaning and sealing, recurring outdoor care, and other services described in an approved written proposal.

Installation, hardscape, construction, remodeling, or permit-related services will be offered only when HAUS or the applicable service provider possesses any licensing required for that scope of work.

Available services, service areas, pricing, and scheduling are subject to change.

  1. WEBSITE PRICING AND CALCULATORS

Website prices and calculator results are preliminary estimates intended to help customers understand likely pricing. They are not binding proposals or guarantees of final cost.

Final pricing may be affected by measurements, surface condition, contamination, access, travel, existing coatings, drainage, stains, repairs, materials, taxes, specialty treatments, site conditions, and the final approved scope.

Projects exceeding stated website limits require an individualized assessment. Work will not begin until the customer approves the applicable proposal or service authorization.

  1. ESTIMATES AND APPROVAL

An estimate remains subject to correction, withdrawal, or revision until accepted by the customer and confirmed by HAUS.

Acceptance through Jobber, electronic signature, email approval, payment, or authorization to begin work constitutes approval of the described scope, pricing, and incorporated terms.

Work outside the approved scope requires additional authorization and may result in additional charges.

  1. SCHEDULING AND PROPERTY ACCESS

The customer must provide safe and reasonable access to the service area at the scheduled time. Gates must be unlocked, vehicles and personal property moved when requested, and pets and children kept safely away from active work areas.

The customer must disclose known hazards, irrigation components, underground utilities, electrical lines, drainage systems, prior coatings, damaged materials, fragile areas, aggressive animals, or other conditions that could affect the work.

HAUS may postpone or stop work when weather, unsafe conditions, inaccessible areas, equipment limitations, undisclosed conditions, or other circumstances prevent the service from being performed safely or properly.

  1. CUSTOMER RESPONSIBILITIES

The customer represents that they own the property or have authority to authorize the requested work.

The customer is responsible for:

• Providing accurate information about the property and requested service
• Providing access to water, electricity, or other utilities when included in the agreed scope
• Removing fragile, valuable, or obstructing items
• Following all preparation and aftercare instructions
• Disclosing known damage, coatings, repairs, contamination, drainage problems, and pet-related conditions
• Obtaining HOA approval or other owner authorization unless the written proposal assigns that responsibility to HAUS

HAUS is not responsible for delays, added costs, or incomplete results caused by inaccurate information or undisclosed conditions.

  1. PAYMENTS

Payment amounts and due dates are stated in the applicable proposal, invoice, or HAUS Care enrollment.

The customer authorizes HAUS and its payment processor to charge the approved payment method for amounts due under the applicable service agreement.

A failed payment may be retried. HAUS may pause future service, withhold scheduling, revoke member benefits, or require payment by another method when an account is past due.

The customer remains responsible for approved services already performed, authorized materials, applicable cancellation charges, and other amounts lawfully due.

  1. HAUS CARE RECURRING SERVICE

HAUS Care is a recurring service program. Available tiers, pricing, minimum charges, service intervals, benefits, and add-ons are described on the HAUS Care page and in the customer’s enrollment confirmation.

The first scheduled service is charged in full. Future service costs may be divided into monthly payments based on the selected service interval. Unless otherwise stated, monthly billing occurs on the calendar date corresponding with the customer’s enrollment date.

Monthly payments may represent installments toward a future scheduled service rather than payment for a service performed during that particular month.

Customers may request a different service frequency, subject to scheduling availability, updated pricing, and any account reconciliation required because of the change.

HAUS Care benefits are available only while the account remains active and current. After 90 days of active membership, members may receive 20% off eligible HAUS labor, up to $500 per membership year. Materials, specialty restoration, taxes, trip or access charges, subcontracted work, and other stated exclusions are not discounted.

Membership pricing and benefits may be modified prospectively with reasonable notice. Changes will not retroactively alter charges already earned or services already approved.

  1. RESCHEDULING AND CANCELLATION

Customers should provide more than 72 hours’ notice when requesting a scheduling change.

A cancellation or rescheduling request received 72 hours or less before the scheduled arrival may result in a $50 late-change fee. HAUS may waive the fee at its discretion for emergencies, unsafe weather, or other documented circumstances.

Recurring-service cancellation procedures and treatment of unused account balances are described in the Cancellation & Refund Policy.

Nothing in these Terms limits a cancellation or refund right that cannot legally be waived. Transactions covered by a federal or state cooling-off requirement will receive the notices and cancellation rights required by law.

  1. SERVICE RESULTS AND EXISTING CONDITIONS

Outdoor surfaces and materials vary by age, installation quality, prior maintenance, exposure, contamination, drainage, substrate, previous coatings, pet use, and environmental conditions.

HAUS does not guarantee complete removal of every odor, stain, mineral deposit, discoloration, seam issue, drainage problem, coating defect, or preexisting condition unless that result is expressly guaranteed in writing.

Cleaning, deodorizing, sanitization, repair, sealing, and restoration can improve a surface without making it new. Some conditions may return or become more visible after cleaning or treatment.

  1. PAVER SERVICES

Paver results depend on surface type, porosity, existing coatings, joint condition, efflorescence, stains, moisture, drainage, preparation, weather, and product compatibility.

Existing sealer removal, specialty stain treatment, efflorescence treatment, joint repair, polymeric sand, and restoration are included only when specifically stated in the approved proposal.

Color enhancement, sheen, texture, and slip characteristics may vary. Customers must follow all cure-time and return-to-use instructions.

  1. TURF SERVICES

Artificial-turf cleaning and grooming do not correct underlying installation defects unless repair work is expressly included.

Odor and contamination can originate beneath the turf, within the base, around edges, in drainage areas, or from continuing pet activity. Additional treatments, extraction, repair, or repeat service may be recommended when routine surface treatment is insufficient.

Sanitization services are intended to treat eligible surfaces according to the agreed process. HAUS does not provide medical, veterinary, or public-health guarantees.

  1. WORKMANSHIP

Eligible work is covered only by the workmanship guarantee stated in the written proposal or service agreement. Coverage, duration, exclusions, and available remedies may vary by service.

A workmanship guarantee does not cover normal wear, pet damage, abuse, neglect, improper aftercare, manufacturer defects, preexisting conditions, movement, drainage failure, weather, acts of third parties, or work altered by someone other than HAUS.

The customer must provide HAUS a reasonable opportunity to inspect and, when covered, correct an alleged workmanship issue before hiring another provider or seeking reimbursement.

  1. PHOTOGRAPHS AND MARKETING

HAUS may photograph the work area for measurement, documentation, quality control, training, and dispute resolution.

HAUS will obtain permission before using identifiable customer information or images that materially identify the customer or property for public marketing. Customers may decline public marketing use without affecting their service.

  1. COMMUNICATIONS

By submitting a request, customers consent to receive communications related to estimates, scheduling, service, billing, and account administration through the contact methods they provide.

Marketing messages will be sent only as permitted by law. Consent to receive marketing messages is not a condition of purchasing services. Message and data rates may apply. Customers may opt out of marketing communications while continuing to receive necessary transactional communications.

  1. THIRD-PARTY SERVICES

HAUS may use third-party platforms including Shopify, Jobber, payment processors, analytics providers, communication providers, and other vendors.

Those platforms may process information under their own terms and privacy policies. HAUS is not responsible for the independent operation or availability of third-party platforms.

  1. WEBSITE CONTENT

Website content, branding, graphics, logos, Klaus from HAUS, photographs, service descriptions, calculators, and other original materials belong to HAUS or its licensors and may not be copied, reproduced, or commercially used without permission.

Website information is provided for general informational purposes and may be updated without notice.

  1. LIMITATION OF LIABILITY

To the fullest extent permitted by law, HAUS will not be responsible for indirect, incidental, special, punitive, or consequential damages arising from website use or service performance.

Nothing in these Terms excludes liability that cannot legally be limited. Any limitation will be applied only to the extent permitted by applicable law.

  1. DELAYS AND EVENTS OUTSIDE OUR CONTROL

HAUS is not responsible for delays caused by weather, unsafe temperatures, rain, wind, material availability, equipment failure, utility interruption, governmental action, permitting, access restrictions, illness, emergencies, or other circumstances reasonably outside HAUS’s control.

HAUS will make reasonable efforts to communicate and reschedule affected work.

  1. GOVERNING LAW

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules. Venue for disputes will lie in Maricopa County, Arizona, unless applicable law requires otherwise.

  1. SEVERABILITY

If any provision is held invalid or unenforceable, the remaining provisions will remain in effect. An unenforceable provision will be limited only to the extent necessary to make it enforceable.

  1. CHANGES TO THESE TERMS

HAUS may update these Terms prospectively. The version posted when a service is approved will govern that transaction unless the parties agree otherwise in writing.
